Explanatory Note

This Bill provides that the Nova Scotia Utility and Review Board must not include bonuses for executive-level employees of electric public utilities as a cost when determining the rate base or general rate for the utility.

An Act to Amend Chapter 380
of the Revised Statutes, 1989,
the Public Utilities Act,
Respecting Eliminating Bonuses
in Power Rates

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Elimination of Bonuses in Power Rates Act.

2 Chapter 380 of the Revised Statutes, 1989, the Public Utilities Act, is amended by adding immediately after Section 41 the following Section:

41A (1) In determining a rate base or general rate for an electric public utility, the Board shall not include any amount based upon performance and paid to executive-level employees, including, but not limited to,

(a) bonuses;

(b) variable compensation; or

(c) at-risk pay.

(2) The Board may make regulations defining "executive-level employees" for the purpose of this Section.
