Explanatory Note

This Bill requires the Minister of Health and Wellness and the Minister responsible for the Liquor Control Act to conduct a public consultation on the Food Safety Regulations respecting the presence of live animals in food establishments and to make a report to the Minister of Agriculture who is responsible for food safety.

An Act to Amend Chapter 4
of the Acts of 2004,
the Health Protection Act

WHEREAS the Food Safety Regulations prohibit the presence of live animals in any food establishment save for guide animals in circumstances where there is no risk of contamination of the food;

AND WHEREAS there is some measure of public demand that these Regulations be amended so as to allow greater latitude in the presence of live animals in food establishments;

AND WHEREAS maintenance of food safety remains an essential policy of good public administration;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 Chapter 4 of the Acts of 2004, the Health Protection Act, is amended by adding immediately after Section 104 the following Section:

    104A (1) The Minister of Health and Wellness and the Minister responsible for the Liquor Control Act shall conduct a public consultation on the Food Safety Regulations respecting the presence of live animals in food establishments and, within one year of this Section coming into force, make a report to the Minister with a recommendation on whether those regulations should be amended and, where it is recommended that they be amended, with a recommendation on how they should or might be amended.

    (2) The report of the Minister of Health and Wellness and the Minister responsible for the Liquor Control Act must be made public within ten days of being made to the Minister.
