Honouring Canadian Armed Forces Members Act

An Act to Honour Members and Retired Members
of the Canadian Armed Forces in Nova Scotia

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Honouring Canadian Armed Forces Members Act.

2 The purpose of this Act is to ensure a welcoming environment in Government owned or operated places for members and retired members of the Canadian Armed Forces and their families and to ensure that their sacrifices in service of Canada are appropriately recognized and respected by Government employees.

3 The Minister responsible for Military Relations has the general supervision and management of this Act.

4 (1) Subject to the regulations, a member or retired member of the Canadian Armed Forces is entitled to wear a Canadian Armed Forces uniform in all places owned or operated by the Government if the uniform

(a) is lawful to be worn by the member or retired member, as the case may be; and

(b) is worn in accordance with all relevant military regulations and orders, including military regulations and orders that determine where and when the uniform may be worn.

(2) No employee of the Government shall, in the course of the employee's duties, prohibit or prevent a member or retired member of the Canadian Armed Forces from wearing a Canadian Armed Forces uniform as provided in this Act.

(3) For greater certainty, nothing in this Act requires the wearing of military uniforms by members or retired members of the Canadian Armed Forces and, in the event of a conflict with any federal statute or regulations governing the Canadian Armed Forces, the federal statute or regulation prevails.

5 (1) The Governor in Council may make regulations

(a) excepting Government owned or operated places from the operation of this Act;

(b) prescribing items that are or are not considered to be part of a Canadian Armed Forces uniform for the purpose of this Act;

(c) defining any word or expression used in this Act;

(d) respecting any other matter the Governor in Council considers necessary or advisable to carry out the intent and purpose of this Act.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.

6 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
