Explanatory Note
This Bill provides that the House of Assembly’s workplace harassment prevention and resolution policy must
(a) require each person to whom the policy applies to begin receiving ongoing in-person education and training respecting harassment in the workplace within six months of becoming a person to whom the policy applies;
(b) not include a time limitation respecting when a complaint must be made or filed;
(c) provide a clear statement that sexual assault is a crime and guidelines as to what constitutes sexual assault under the Criminal Code; and
(d) require any sexual assault complaint to immediately be reported to the proper authorities by the Speaker of the House.
An Act to Amend Chapter 1
(1992 Supplement)
of the Revised Statutes, 1989,
the House of Assembly Act
1 Section 32A of Chapter 1 (1992 Supplement) of the Revised Statutes, 1989, the House of Assembly Act, as enacted by Chapter 10 of the Acts of 2016, is amended by adding immediately after subsection (2) the following subsection:
- (3) A policy established pursuant to subsection (1) must
(a) require each person to whom the policy applies to begin receiving ongoing in-person education and training respecting harassment in the workplace within six months of becoming a person to whom the policy applies;
(b) not include a time limitation respecting when a complaint must be made or filed;
(c) provide a clear statement that sexual assault is a crime and guidelines as to what constitutes sexual assault under the Criminal Code (Canada); and
(d) require that any sexual assault complaint immediately be reported by the Speaker to the proper authorities upon the complaint being made.
2 This Act comes into force six months after this Act receives Royal Assent.
