Explanatory Note

This Bill

(a) enshrines the Seniors' Pharmacare Program in the Fair Drug Pricing Act;

(b) enshrines a cost-share ratio range for the funding of the Seniors' Pharmacare Program; and

(c) requires that surplus funding be invested in health initiatives that benefit senior citizens.

An Act to Amend Chapter 7
of the Acts of 2011,
the Fair Drug Pricing Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 7 of the Acts of 2011, the Fair Drug Pricing Act, is amended by adding immediately after Section 3 the following Section:

3A (1) The Minister shall establish and maintain under the Plan a Seniors' Pharmacare Program for residents who are sixty-five years of age or older.

(2) The aggregate amount of all copayments and premiums paid under the Program during any fiscal year of the Program must be at least twenty-two per cent, but must not exceed twenty-eight per cent, of the budgeted total cost of the Program for the fiscal year.

(3) Where, for any fiscal year of the Seniors' Pharmacare Program, the aggregate amount of the money appropriated by the Legislature for the Program and all copayments and premiums paid under the Program exceeds the cost of the Program, the Minister shall invest the surplus in health programs and initiatives that benefit residents of the Province who are sixty-five years of age or older.
