An Act to Amend Chapter 401
of the Revised Statutes, 1989,
the Residential Tenancies Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 9(2) of Chapter 401 of the Revised Statutes, 1989, the Residential Tenancies Act, is amended by

(a) adding ", whether by requiring aesthetic improvements or upgrades to the mobile home as a condition of the sales or lease or otherwise" immediately after "tenant" in the fourth line of Statutory Condition 1.; and

(b) adding immediately after Statutory Condition 1. the following Statutory Condition:

1A. Where a tenant sells or otherwise parts with possession of a mobile home, the person who acquires title to the mobile home or possession of the mobile home may apply to the landlord of the mobile home park in which that mobile home is located to become a tenant of the landlord in the same mobile home space upon which the mobile home was located at the time of the sale or change of possession, and the landlord may not arbitrarily or unreasonably withhold consent to that person becoming a tenant in that space.

2 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
