An Act Respecting
Fetal Alcohol Spectrum Disorder

WHEREAS people with fetal alcohol spectrum disorder have the same rights as all other Nova Scotians: the right to identity, culture, connection and safety, the right to access education, healthcare and disability supports, the right to be heard and the right to be free from discrimination;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Fetal Alcohol Spectrum Disorder Act.

2 (1) Subject to subsection (2), the Government shall create a fund to support Nova Scotians with fetal alcohol spectrum disorder and their families.

(2) The money required for the purpose of subsection (1) must be paid out of money appropriated for that purpose by the Legislature.

3 The Province hereby indicates its support for Senate Bill S-253, An Act respecting a national framework for fetal alcohol spectrum disorder.

4 Section 96A of Chapter 260 of the Revised Statutes, 1989, the Liquor Control Act, as enacted by Chapter 39 of the Acts of 2004, is amended by adding "(1)" immediately after the Section number and adding immediately after subsection (1) the following subsection:

    (2) Regulations made under subsection (1) must include detailed requirements for the design and location of signage warning of the harms caused by prenatal alcohol exposure.
