An Act to Preserve
the Independence of Student Unions

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Student Union Independence Act.

2 In this Act,

(a) "association of student unions" means an organization that represents two or more student unions;

(b) "student union" means an organization that represents the students of a post-secondary educational institution and includes

    (i) the Acadia Students' Union,

    (ii) the Association générale des étudiants de l'Université Sainte-Anne,

    (iii) the Atlantic School of Theology Student Union,

    (iv) the Cape Breton University Students' Union,

    (v) the Dalhousie Association of Graduate Students,

    (vi) the Dalhousie Student Union,

    (vii) the King's Students' Union,

    (viii) the Mount Saint Vincent University Students' Union,

    (ix) the Nova Scotia Community College Student Association,

    (x) the Saint Mary's University Students' Association,

    (xi) the St. Francis Xavier University Students' Union,

    (xii) the Student Union of NSCAD University, and

    (xiii) an organization prescribed as a student union by the regulations.

3 (1) Notwithstanding any contract, by-law, regulation or policy, a student union may disassociate itself from an association of student unions by a vote of its membership in which a majority of those voting vote in favour of disassociation.

(2) Subject to subsection (3), where a student union disassociates itself from an association of student unions pursuant to subsection (1), any conditions, debts or obligations owed by the student union to the association of student unions are void.

(3) Subsection (2) does not apply to a condition, debt or obligation owed by the student union to the association of student unions if

(a) the condition, debt or obligation was incurred prior to the vote in favour of disassociation; and

(b) the condition, debt or obligation would be imposed irrespective of whether the student union disassociates.

4 (1) The Minister of Labour and Advanced Education may make regulations prescribing an organization as a student union.

(2) The exercise by the Minister of Labour and Advanced Education of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.
