Explanatory Note

This Bill amends the Education Act and the Education (CSAP) Act to prohibit teachers and principals from disciplining a student for the student's participation in public policy advocacy.

An Act to Amend Schedule A of Chapter 1
of the Acts of 2018,
the Education Act,
and Chapter 1 of the Acts of 1995-96,
the Education (CSAP) Act

Be it enacted by the Governor and Assembly as follows:

1 Schedule A of Chapter 1 of the Acts of 2018, the Education Act, is amended by adding immediately after Section 25 the following Section:

    25A (1) For the purpose of this Section, "public policy advocacy" includes

    (a) public demonstrations;

    (b) wearing buttons or other forms of communication; and

    (c) circulating petitions.

    (2) Subject to the school's anti-harassment or anti-bullying policies, no teacher or principal shall discipline a student for the student's participation in public policy advocacy.

2 Chapter 1 of the Acts of 1995-96, the Education (CSAP) Act, is amended by adding immediately after Section 24 the following Section:

    24A (1) For the purpose of this Section, "public policy advocacy" includes

    (a) public demonstrations;

    (b) wearing buttons or other forms of communication; and

    (c) circulating petitions.

    (2) Subject to the school's anti-harassment or anti-bullying policies, no teacher or principal shall discipline a student for the student's participation in public policy advocacy.
