An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 42(4) of Chapter 1 of the Acts of 1995-96, the Education Act, is amended by striking out "that has a tuition agreement with a Mi'kmaq band council" in the third and fourth lines.

2 Section 64A of Chapter 1, as enacted by Chapter 5 of the Acts of 2002, is amended by striking out "Governor in Council" in the third line and substituting "Minister".

3 Section 64D of Chapter 1 is repealed and the following Section substituted:

64D On and after September 1, 2009, a school board shall, in accordance with this Act and the regulations, provide for the supervision of students at a public school during the student's lunch break at no cost to the student.

4 Subsection 146(1) of Chapter 1, as amended by Chapter 11 of the Acts of 2000, Chapter 5 of the Acts of 2002, Chapter 3 of the Acts of 2004, Chapter 4 of the Acts of 2004, Chapter 16 of the Acts of 2005 and Chapter 27 of the Acts of 2006, is further amended by

(a) striking out clause (yc); and

(b) striking out "the Southwest Regional School Board and" in the second and third lines of clause (ye).

5 Section 47 of Chapter 9 of the Acts of 2003, the Municipal Law Amendment (2003) Act, is repealed.

6 This Act comes into force on such day as the Governor in Council order and declares by proclamation.
