Explanatory Notes

Clause 1 removes a requirement for the Minister of Municipal Affairs and Housing to approve the entering into of leases, lease-purchases and other arrangements by municipalities where the total commitment exceeds $100,000.

Clause 2 removes a requirement for the approval of the Minister of Municipal Affairs and Housing where an action of a municipality already requires the approval of a different minister.

Clause 3 removes a requirement for the Minister of Municipal Affairs and Housing to approve the entering into of leases, lease-purchases and other arrangements by the Halifax Regional Municipality where the total commitment exceeds $500,000.

An Act to Amend Chapter 18
of the Acts of 1998,
the Municipal Government Act,
and Chapter 39 of the Acts of 2008,
the Halifax Regional Municipality Charter,
Respecting Ministerial Approvals

Be it enacted by the Governor and Assembly as follows:

MUNICIPAL GOVERNMENT ACT

1 Subsections 88(4) and (5) of Chapter 18 of the Acts of 1998, the Municipal Government Act, are repealed and the following subsection substituted:

    (4) A municipality may enter into a lease, lease-purchase or other commitment to pay money over a period extending beyond the end of the current fiscal year.

2 Subsection 450(1) of Chapter 18 is repealed.

HALIFAX REGIONAL MUNICIPALITY CHARTER

3 Subsections 111(5) and (6) of Chapter 39 of the Acts of 2008, the Halifax Regional Municipality Charter, are repealed and the following subsection substituted:

    (5) The Municipality may enter into a lease, lease-purchase or other commitment to pay money over a period extending beyond the end of the current fiscal year.
