Explanatory Note

This Bill requires the Minister to perform regular inspections on bridges and overpasses and to post the results on the Government website within 90 days of completion.

An Act to Amend Chapter 371
of the Revised Statutes, 1989,
the Public Highways Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 371 of the Revised Statutes, 1989, the Public Highways Act, is amended by adding immediately after Section 5 the following Section:

5A (1) Subject to subsection (5), the Minister shall schedule visual inspections of all bridges and overpasses such that the footing, substructure, deck and superstructure are inspected every two years.

(2) Subject to subsection (5), the Minister shall schedule underwater inspections of bridges every five years.

(3) An in-depth inspection must be undertaken immediately if damage to a bridge or overpass is discovered on inspection or reported to the Minister.

(4) Every inspection referred to in subsections (1) to (3) must be posted on the Government website within ninety days of completion.

(5) The moneys required for the purpose of this Act must be paid out of moneys appropriated for that purpose by the Legislature.
