Explanatory Note

This Bill provides that no commission of inquiry on the remuneration of elected provincial officials shall be appointed to determine indemnities, allowances and salaries for the year 2006 and, for that year, provides that the percentage increase in the indemnities, allowances and salaries is to be 2.9% or, if greater, the percentage increase in salary provided to civil servants for the 2004-05 fiscal year.

An Act to Amend Chapter 1
(1992 Supplement)
of the Revised Statutes, 1989,
the House of Assembly Act

Be it enacted by the Governor and Assembly as follows: 1 Section 45 of Chapter 1 (1992 Supplement) of the Revised Statutes, 1989, the House of Assembly Act, as amended by Chapter 47 of the Acts of 2001, Chapter 34 of the Acts of 2002 and Chapters 3 and 37 of the Acts of 2004, is further amended by adding immediately after subsection (9) the following subsection:
(10) Notwithstanding subsections (1) to (4),

(a) the Speaker shall not, in the year 2005, appoint persons pursuant to subsection (1); and

(b) for the year 2006, the annual indemnity and allowance for expenses to be paid pursuant to this Act and the salaries to be paid pursuant to this Act and the Executive Council Act shall be 102.9% of those amounts paid pursuant to this Act and the Executive Council Act for the year 2005 plus the percentage of those amounts for 2005 that the percentage increase in salary provided to civil servants for the fiscal year 2004-05 exceeds 2.9%.

2 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
