An Act to Establish
the Nova Scotia Healthcare Trust

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Healthcare Trust Act.

2 In this Act,

"health authority" has the same meaning as in the Health Authorities Act;

"Minister" means the Minister of Health and Wellness;

"tobacco-related disease" has the same meaning as in the Tobacco-damages and Health-care Costs Recovery Act;

"tobacco-related wrong" has the same meaning as in the Tobacco-damages and Health-care Costs Recovery Act;

"Trust" means the Nova Scotia Healthcare Trust.

3 (1) The Nova Scotia Healthcare Trust is established and is deemed to be a special purpose fund under Section 10 of the Finance Act.

(2) Notwithstanding Section 10 of the Finance Act, the Minister has on-going responsibility for the Trust.

4 All money paid to the Province as damages in respect of a tobacco-related wrong must be deposited in the Trust.

5 Money in the Trust may be used only for

(a) establishing family doctor clinics to help ensure that those impacted by tobacco-related disease have ongoing support close to home;

(b) enhancing public health initiatives for prevention of tobacco-related disease; or

(c) improving access to supportive services for those impacted by tobacco-related disease.

6 The Minister shall prepare for each fiscal year a report regarding the use of money in the Trust and the report must be included in the Public Accounts tabled by the Minister of Finance under Section 59 of the Finance Act.
