Explanatory Note

This Bill requires witnesses for the prosecution in indictable cases to be paid the same fees as employees of the Province for travel and $100 for each day of actual attendance before a justice of the peace or a judge in such cases instead of as prescribed by regulations.

An Act to Amend Chapter 104
of the Revised Statutes, 1989,
the Costs and Fees Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 16(1) of Chapter 104 of the Revised Statutes, 1989, the Costs and Fees Act, as amended by Chapter 3 of the Acts of 2004, is further amended by striking out "fees prescribed in the regulations for his travel and" and substituting "same fees for travel as employees of the Province and one hundred dollars per day for".

(2) Subsection 16(2) of Chapter 104 is amended by striking out "prescribed in the regulations" and substituting "referred to in subsection (1)".
