Explanatory Note
This Bill limits the fees under the Act to a $5.00 application fee.
An Act to Amend Chapter 5
of the Acts of 1993,
the Freedom of Information
and Protection of Privacy Act
Be it enacted by the Governor and Assembly as follows:
1 Clause 6(1)(c) of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, is amended by striking out "any fees required pursuant to" in the first line and substituting "the fee required by".
2 Subclause 7(2)(a)(i) of Chapter 5 is amended by striking out "prescribed" in the third line and substituting "application".
3 (1) Subsection 11(1) of Chapter 5 is amended by striking out "the application fee prescribed by the regulations" in the second and third lines and substituting "an application fee of five dollars".
(2) Subsections 11(2) and (3) of Chapter 5 are repealed and the following subsection substituted:
- (2) For greater certainty, no fees are payable in addition to the fee set out in subsection (1).
(3) Subsection 11(4) of Chapter 5 is amended by striking out "Subsections (1) and (2) do" in the first line and substituting "Subsection (1) does".
4 Clauses 49(1)(b) and (c) of Chapter 5 are repealed.
