An Act to Amend Chapter 44
of the Acts of 2005,
the Pre-primary Education Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 44 of the Acts of 2005, the Pre-primary Education Act, is amended by adding immediately after Section 1 the following Section:

1A In this Act, "Minister" means the Minister of Education and Early Childhood Development.

2 Section 2 of Chapter 44 is amended by striking out "of Education" in the first line.

3 Subsection 3(1) of Chapter 44 is amended by

(a) striking out "or of any other" in the first line of clause (e) and substituting "of any"; and

(b) adding immediately after clause (e) the following clause:

(ea) respecting agreements in relation to a pre-primary program;

4 Chapter 44 is further amended by adding immediately after Section 3 the following Sections:

3A The Minister may enter into an agreement with a person, agency, organization, association, institution, municipality or other body, including the Government of Canada, respecting the establishment and delivery of a pre-primary program or related services, including an agreement respecting contributions to the cost of delivering a pre-primary program or related services in the Province.

3B (1) Notwithstanding the Education Act, a school board may, with the approval of the Minister and subject to the regulations, offer a pre-primary program.

(2) With the approval of the Minister and subject to the regulations, a school board may enter into an agreement with a person, agency, organization, association, institution, municipality or other body respecting the delivery of a pre-primary program or related services.
