Explanatory Note

This Bill makes meetings of the board of the provincial health authority and its committees open to the public and requires minutes and agendas of those meetings to be published on the provincial health authority's website.

An Act to Amend Chapter 32
of the Acts of 2014,
the Health Authorities Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 32 of the Acts of 2014, the Health Authorities Act, is amended by adding immediately after Section 57 the following Section:

    57A (1) Except as otherwise provided in this Section, meetings of the board of the provincial health authority and meetings of committees established by the board are open to the public.

    (2) The board or any committee established by the board may meet in closed session to discuss matters relating to

    (a) acquisition, sale, lease and security of property;

    (b) personnel matters;

    (c) labour relations;

    (d) contract negotiations;

    (e) litigation or potential litigation;

    (f) legal advice eligible for solicitor-client privilege;

    (g) the security of any premises under the control of the provincial health authority; and

    (h) any subject, the discussion of which could, in the opinion of the board or the committee, as the case may be, violate the confidentiality of information obtained from

      (i) the Government of Canada or the Government of the Province,

      (ii) an agency of the Government of Canada or the Government of the Province,

      (iii) a public body, or

      (iv) a patient.

    (3) No decision may be made at a private meeting of the board or a committee except a decision concerning procedural matters or to give direction to staff of, or solicitors for, the provincial health authority.

    (4) A record that is open to the public must be made, noting the fact that the board or committee met in private, the type of matter that was discussed, as set out in subsection (2) and the date, but no other information.

    (5) The minutes and agenda of any meeting of the board or a committee that is open to the public must be published on the provincial health authority's website.
