Explanatory Notes

Clause 1 changes the title of An Act to Provide for the Establishment of a Boxing Authority for Nova Scotia to reflect the change of the Nova Scotia Boxing Authority to the Nova Scotia Combat Sports Authority.

Clause 2 changes the short title of the Act to reflect the change in the Authority.

Clause 3

(a) amends the definitions of "Authority", "contest", "gross gate receipts", "Minister", "official", "participant" and "promoter";

(b) deletes the definitions of "boxer", "boxing", "closed circuit television" and "exhibition"; and

(c) adds a definition of "contestant".

Clause 4 changes the name of the Nova Scotia Boxing Authority to the Nova Scotia Combat Sports Authority, removes references to defunct Commissions and authorizes the Governor in Council to appoint a Referee in Chief and Advisor to the Authority.

Clause 5

(a) clarifies that the Secretary-treasurer, Medical Advisor and other necessary officers and employees may be appointed by the Authority;

(b) permits the Authority, with the approval of the Minister, to engage the assistance of staff in the Minister's Department; and

(c) updates some language.

Clauses 6 and 7 update the language of the Act.

Clause 8

(a) changes the reference to the objects of the Authority to its powers;

(b) removes references to "boxing"; and

(c) replaces a reference to "boxers" with "contestants".

Clause 9

(a) replaces "boxers" with "contestants";

(b) replaces "boxing" with "combat sport";

(c) replaces "closed circuit television" with "pay-per-view"; and

(d) adds regulation-making power with respect to contests involving amateur athletes.

Clause 10 replaces "boxing contest or exhibition" with "contest".

Clause 11 deletes regulation-making authority for amateur boxing that was moved by Clause 8 to another Section of the Act.

Clause 12 removes a reference to a repealed Section.

Clause 13 provides that this Act comes into force on proclamation.

An Act to Amend Chapter 43
of the Revised Statutes, 1989,
the Boxing Authority Act

Be it enacted by the Governor and Assembly as follows:

1 The title of Chapter 43 of the Revised Statutes, 1989, the Boxing Authority Act, is amended by striking out "Boxing" in the second line and substituting "Combat Sports".

2 Section 1 of Chapter 43 is amended by striking out "Boxing" in the first line and substituting "Combat Sports".

3 Section 2 of Chapter 43 is amended by

(a) striking out "Boxing" in the first line of clause (a) and substituting "Combat Sports";

(b) striking out clauses (b) to (f) and substituting the following clauses:

(b) "contest" means a contest or exhibition of professional boxing, professional mixed martial arts or any other professional combat sport that is designated by the regulations;

(c) "contestant" means an athlete who engages in a contest;

(c) striking out "boxing match" in the second line of clause (g) and substituting "contest";

(d) striking out "boxing match or exhibition" in the fourth and fifth lines of clause (g) and substituting "contest";

(e) striking out "to whom the Nova Scotia Sport and Recreation Commission reports" in the second and third lines of clause (h) and substituting "responsible for sport";

(f) striking out "boxing" in the second line of clause (i) and substituting "combat sport";

(g) striking out "boxer" in the second line of clause (j) and substituting "contestant"; and

(h) striking out "boxing contest or exhibition" in the last line of clause (l) and substituting "contest".

4 (1) Subsection 3(1) of Chapter 43 is amended by striking out "Boxing" in the second line and substituting "Combat Sports".

(2) Subsection 3(2) of Chapter 43 is repealed.

(3) Chapter 43 is further amended by adding immediately after Section 3 the following Section:

3A The Governor in Council may appoint one person who is not a member to be the Referee in Chief and Advisor to the Authority.

5 (1) Subsection 4(1) of Chapter 43 is repealed and the following subsections substituted:

(1) The Authority may appoint a Secretary-treasurer, Medical Adviser and such other officers and employees as may be required by the Authority for the proper conduct and management of the Authority.

(1A) Notwithstanding subsection (1), the Authority may, subject to the approval of the Minister, avail itself of the services of staff in the Minister's Department.

(2) Subsection 4(2) of Chapter 43 is amended by striking out "boxing contests or exhibitions" in the last two lines and substituting "contests".

(3) Subsection 4(3) of Chapter 43 is amended by striking out "Consolidated" in the last line and substituting "General Revenue".

6 Section 6 of Chapter 43 is amended by striking out "Consolidated" in the last line and substituting "General Revenue".

7 Subsection 7(2) of Chapter 43 is amended by

(a) striking out "boxing contest or exhibition" in the second line and substituting "contest"; and

(b) striking out "or exhibition" in the last line.

8 Section 9 of Chapter 43 is amended by

(a) striking out the first line and substituting "The Authority may";

(b) striking out "boxing" in the first line of clause (a) and substituting "contests";

(c) striking out "boxing" in the second line of clause (b) and substituting "contestants";

(d) striking out "boxing contests or exhibitions" in the second and third lines of clause (c) and substituting "contests"; and

(e) striking out "boxers" in the third line of clause (d) and substituting "contestants".

9 Section 10 of Chapter 43 is amended by

(a) striking out "boxers" in the first and second lines of clause (b) and substituting "contestants";

(b) striking out "boxers" in the second line of clause (g) and substituting "contestants";

(c) striking out "boxers" in the second line of clause (h) and substituting "contestants";

(d) striking out "boxing contest or exhibition" in the second line of clause (i) and substituting "contest";

(e) striking out "boxers" in the second line of clause (j) and substituting "contestants";

(f) striking out clause (l) and substituting the following clause:

(l) designating combat sports for the purpose of the definition of contest;

(g) striking out "closed circuit televised contest or exhibition" in the first and second lines of clause (n) and substituting "pay-per-view contest"; and

(h) striking out clause (o) and substituting the following clauses:

(o) concerning the medical examination of all contestants and the availability of medical assistance during any contest;

(p) governing the participation of amateur athletes in contests.

10 (1) Subsection 11(1) of Chapter 43 is amended by striking out "boxing contest or exhibition" in the second line and substituting "contest".

(2) Subsection 11(2) of Chapter 43 is amended by striking out "boxing contest or exhibition" in the second line and substituting "contest".

11 Section 15 of Chapter 43 is repealed.

12 Section 16 of Chapter 43 is amended by striking out "Sections 10 and 15" in the second and third lines and substituting "Section 10".

13 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
