An Act to Amend Chapter 3
of the Acts of 1992,
the Dental Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 17(1) of Chapter 3 of the Acts of 1992, the Dental Act, as amended by Chapter 37 of the Acts of 2000 and Chapter 29 of the Acts of 2007, is further amended by

(a) striking out "and" in clause (e) and substituting a comma;

(b) adding "and a Registration Appeal Committee" immediately after "Committee" the second time it appears in clause (e); and

(c) striking out clause (g).

2 Section 20 of Chapter 3, as amended by Chapter 37 of the Acts of 2000 and Chapter 29 of the Acts of 2007, is further amended by adding immediately after clause (b) the following clause:

(ba) impose conditions or restrictions on a certificate of registration or licence issued pursuant to clause (b), if required for the protection of the public and for appropriate patient care;

3 Clause 25(1)(f) of Chapter 3 is amended by striking out "Board" in the third line and substituting "Registrar, the Registration Appeal Committee".

4 Clause 27(1)(f) of Chapter 3 is amended by striking out "Board" in the third line and substituting "Registrar, the Registration Appeal Committee".

5 (1) Subsection 31(1) of Chapter 3 is repealed and the following subsection substituted:

(1) A person who is dissatisfied with a decision of the Registrar respecting registration or licensing or otherwise relating to entries in either the Dentists' Register or the Dental Assistants' Register may appeal from the decision to the Registration Appeal Committee.

(2) Subsection 31(2) of Chapter 3 is amended by striking out "Board" in the second line and substituting "Registration Appeal Committee".

(3) Section 31 of Chapter 3, as amended by Chapter 29 of the Acts of 2007, is further amended by adding immediately after subsection (2) the following subsection:

(3) The Registration Appeal Committee's decision made pursuant to subsection (2) is final.

6 (1) Subsection 34A(2) of Chapter 3, as enacted by Chapter 3 of the Acts of 2008, is amended by

(a) striking out "or" in the third line and substituting a comma;

(b) adding "or the Registration Appeal Committee" immediately after "Committee" in the fourth line; and

(c) adding ", the Registration Appeal Committee" immediately after "Committee" in the last line.

(2) Subsection 34A(4) of Chapter 3, as enacted by Chapter 3 of the Acts of 2008, is amended by

(a) striking out "or" in the second line and substituting a comma; and

(b) adding "or the Registration Appeal Committee" immediately after "Committee" in the third line.

7 (1) Subsection 43(1) of Chapter 3, as amended by Chapter 37 of the Acts of 2000, is further amended by

(a) striking out "and" in the first line and substituting a comma;

(b) adding "and the Registration Appeal Committee" immediately after "Committee" in the second line; and

(c) adding "with the exception of the powers of contempt, arrest and imprisonment" immediately after "Act" in the last line.

(2) Subsection 43(2) of Chapter 3 is amended by adding "with the exception of the powers of contempt, arrest and imprisonment" immediately after "Act" in the last line.

8 Subsection 44(1) of Chapter 3, as amended by Chapter 37 of the Acts of 2000, is further amended by

(a) striking out "or" in the third line and substituting a comma; and

(b) adding "or the Registration Appeal Committee" immediately after "Committee" the second time it appears in the third line.

9 Subsection 45(1) of Chapter 3, as amended by Chapter 37 of the Acts of 2000 and Chapter 29 of the Acts of 2007, is further amended by adding immediately after clause (d) the following clauses:

(da) respecting the powers, authority and processes of the Registrar;

(db) constituting a Registration Appeal Committee;

(dc) prescribing the powers and procedures of the Registration Appeal Committee;

(dd) prescribing the actions, sanctions or other remedies that the Registration Appeal Committee may impose with respect to appeals;
