Explanatory Note

This Bill adds regulation-making authority

(a) prescribing restrictions and conditions on teacher certificates and teaching permits;

(b) authorizing teachers to surrender their certificate or teaching permit;

(c) respecting the reporting within and outside Nova Scotia of the suspension or cancellation of teacher's certificates and teaching permits as well as restrictions and conditions on them; and

(d) respecting the disclosure of information pertaining to the suspensions or cancellation of or the restrictions or conditions on a teacher's certificate or teaching permit.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 146(1) of Chapter 1 of the Acts of 1995-96, the Education Act, as amended by Chapter 5 of the Acts of 2002, is further amended by adding immediately after clause (e) the following clauses:

(ea) prescribing restrictions or conditions on a teacher's certificate or a teaching permit;

(eb) authorizing the holder of a teacher's certificate or a teaching permit to surrender the certificate or teaching permit;

(ec) respecting the reporting of the suspension or cancellation of, or restrictions or conditions on, a teacher's certificate or a teaching permit to school boards in the Province and teacher certification authorities within and outside Canada;

(ed) respecting the disclosure of information pertaining to the suspension or cancellation of, or restrictions or conditions on, a teacher's certificate or teaching permit;

2 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
