Buy Local Wild Blueberries Act

An Act to Require the Government of Nova Scotia
to Purchase Local Wild Blueberries
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Buy Local Wild Blueberries Act.
2 This Act binds Her Majesty in right of the Province.
3 (1) Subject to the terms of any program established under Section 4 and to Section 7, where any department or office of the public service, within the meaning of the Public Service Act, buys food items to supply the operations carried out by a department or office, it shall give preference to the purchase of wild blueberries grown and harvested in the Province and shall purchase such blueberries in accordance with the regulations.
(2) When purchasing wild blueberries in accordance with subsection (1), a department or office of the public service may increase the quantity of wild blueberries purchased if
(a) there is a demonstrable over-supply of wild blueberries; or
(b) the market price of wild blueberries is demonstrably depressed.
4 The Government shall endeavour to establish a program jointly with the Governments of New Brunswick, Newfoundland and Labrador and Prince Edward Island to give preference to the purchase of wild blueberries grown and harvested in Atlantic Canada.
5 (1) The Governor in Council may make regulations
(a) respecting the purchase of wild blueberries grown and harvested in Atlantic Canada by departments and offices;
(b) respecting the manner in which departments and offices are to give preference to the purchase of wild blueberries grown and harvested in Atlantic Canada;
(c) defining any word or expression used but not defined in this Act;
(d) respecting any matter or thing the Governor in Council considers necessary or advisable to effectively carry out the intent and purpose of this Act.
(2) The exercise by the Governor in Council of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.
6 The Government shall, within 90 days after the coming into force of this Act, make public draft regulations for the purpose of this Act.
7 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
