Explanatory Notes

Clause 1 provides that all members of the Board of Governors of the Art Gallery of Nova Scotia are appointed for a term not exceeding three years. At present, a member representing a visual arts organization is appointed for a term of one year.

Clause 2 removes the present by-law powers of the Board which are being added by subclause 3(a) to Section 11.

Clause 3

(a) adds simplified by-law powers of the Board; and

(b) removes some powers of the Board which are being added by Clause 4 to Section 11A.

Clause 4 adds existing powers of the Board from Section 11 so that they will no longer be subject to approval of the Minister of Communities, Culture and Heritage or the Governor in Council.

Clause 5 repeals a provision rendered redundant by Clause 2.

An Act to Amend Chapter 22
of the Revised Statutes, 1989,
the Art Gallery of Nova Scotia Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 5(3) of Chapter 22 of the Revised Statutes, 1989, the Art Gallery of Nova Scotia Act, is amended by striking out everything after "determines" in the third line and substituting a period.

2 Section 10 of Chapter 22 is repealed.

3 Section 11 of Chapter 22, as amended by Chapter 54 of the Acts of 2012, is further amended by

(a) adding immediately after clause (a) the following clause:

and

(b) striking out clauses (e) and (h).

4 Section 11A of Chapter 22, as enacted by Chapter 54 of the Acts of 2012, is amended by adding immediately after clause (g) the following clauses:

5 Section 17 of Chapter 22 is repealed.
