Explanatory Notes

Clause 1

(a) amends the definitions of "apprentice", "apprenticeship agreement" and "Director" and adds definitions of "extra-provincial apprenticeship recognition agreement" and "pre-employment apprenticeship-training recognition agreement"; and

(b) adds an interpretative clause with respect to "ordinarily resident".

Clause 2 allows the employment of the Chief Executive Officer to be made pursuant to the Civil Service Act or under a personal services contract.

Clause 3 requires a Director of Partnership and Innovation, in addition to the Director of Programs and Operations, to be appointed pursuant to the Civil Service Act.

Clause 4 revises the duties of the Director to

(a) require the Director to record credits acquired by an apprentice in Nova Scotia or in a province or territory that has an extra-provincial apprenticeship recognition agreement with Nova Scotia;

(b) require the Director to record credits acquired by a person through pre-employment apprenticeship training in Nova Scotia or in a province or territory that has a pre-employment apprenticeship-training recognition agreement with Nova Scotia; and

(c) remove the responsibility for establishing curriculum standards for technical training and monitoring the training,

and corrects an error.

Clause 5 gives the following duties and powers to the Director of Partnership and Innovation:

(a) granting credit to an apprentice for technical training and practical experience through employment in Nova Scotia or in a province or territory that has an extra-provincial apprenticeship recognition agreement with Nova Scotia;

(b) granting credit to a person for pre-employment apprenticeship training acquired in Nova Scotia or in a province or territory that has a pre-employment apprenticeship-training recognition agreement;

(c) establishing curriculum standards for technical training and monitoring the training;

(d) prescribing forms and their use; and

(e) such other duties as may be assigned.

Clause 6

(a) adds the Director as a party to all apprenticeship agreements which will

(b) requires the Director of Partnership and Innovation to grant credit to a prospective apprentice for previous training or experience acquired in another province or territory in accordance with a pre-employment apprenticeship-training recognition agreement;

(c) allows an employer to withdraw from an apprenticeship agreement without causing the agreement to end;

(d) allows an apprentice to terminate an apprenticeship agreement without the consent of the employer or Director, but requires the apprentice to give written notice to the Director;

(e) permits the Director to become a party to an existing apprenticeship agreement.

Clause 7 allows the Director to enter into an apprenticeship agreement with a prospective apprentice who is

(a) ordinarily resident in Nova Scotia;

(b) not currently employed in Nova Scotia;

(c) employed in a province or territory that has an extra-provincial apprenticeship recognition agreement with the Minister, or has been so employed;

(d) determined eligible for credit by the Director of Partnership and Innovation; and

(e) likely to benefit from entering into an apprenticeship agreement with the Director, in the opinion of the Director.

Clause 8 gives the Minister authority to enter into extra-provincial apprenticeship recognition agreements and pre-employment apprenticeship-training recognition agreements.

Clause 9 makes consequential amendments to the Governor in Council's regulation-making powers with respect to

(a) making the Director a party to all apprenticeship agreements; and

(b) the ability of the Director to grant credit for previous training and experience.

An Act to Amend Chapter 1
of the Acts of 2003,
the Apprenticeship and Trades Qualifications Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Section 2 of Chapter 1 of the Acts of 2003, the Apprenticeship and Trades Qualifications Act, as amended by Chapter 23 of the Acts of 2006 and Chapter 3 of the Acts of 2014, is further amended by

(a) striking out "with an employer" in the second line of clause (b);

(b) striking out clause (c) and substituting the following clause:

(c) striking out clause (k) and substituting the following clause:

(d) adding immediately after clause (nb) the following clause:

and

(e) adding immediately after clause (s) the following clause:

(2) Section 2 of Chapter 1, as amended by Chapter 23 of the Acts of 2006 and Chapter 3 of the Acts of 2014, is further amended by

(a) adding "(1)" immediately after the Section number; and

(b) adding the following subsection:

2 Subsection 6(1) of Chapter 1, as enacted by Chapter 3 of the Acts of 2014, is amended by adding "and may be employed pursuant to the Civil Service Act or Personal Services Contract Regulations made under the Public Service Act" immediately after "Minister" in the second line.

3 Section 7 of Chapter 1, as enacted by Chapter 3 of the Acts of 2014, is amended by striking out "A Director" in the first line and substituting "The Director of Programs and Operations, the Director of Partnership and Innovation".

4 Section 8 of Chapter 1, as enacted by Chapter 3 of the Acts of 2014, is amended by

(a) adding immediately after clause (a) the following clauses:

(b) striking out "inquires" in the first line of clause (b) and substituting "inquiries"; and

(c) striking out clause (e).

5 Chapter 1 is further amended by adding immediately after Section 8 the following Section:

6 (1) Subsection 18(1) of Chapter 1 is amended by

(a) adding "jointly" immediately after "shall" in the last line; and

(b) adding "with the Director" immediately after "agreement" in the last line.

(2) Subsection 18(2) of Chapter 1 is amended by striking out "A" in the first line and substituting "Either an employer or an apprentice who is a".

(3) Subsection 18(5) of Chapter 1, as amended by Chapter 3 of the Acts of 2014, is further amended by adding "of Partnership and Innovation" immediately after "Director" in the first line.

(4) Section 18 of Chapter 1, as amended by Chapter 3 of the Acts of 2014, is further amended by adding immediately after subsection (5) the following clause:

(5) Subsection 18(7) of Chapter 1 is repealed and the following subsections substituted:

(6) Subsections 18(9) and (9A) of Chapter 1 are repealed and the following subsection substituted:

7 Chapter 1 is further amended by adding immediately after Section 18 the following Section:

8 Section 26 of Chapter 1, as amended by Chapter 3 of the Acts of 2014, is further amended by striking out clause (aa) and substituting the following clauses:

9 Subsection 29(1) of Chapter 1, as amended by Chapter 23 of the Acts of 2006 and Chapter 3 of the Acts of 2014, is further amended by

(a) adding "withdrawal from and" immediately after "for" in the first line of clause (q);

(b) striking out "parties" in the second line of clause (q) and substituting "other parties, if any,"; and

(c) striking out clause (aj) and substituting the following clause:
