Explanatory Notes

Clause 1 sets out the short title of the Act.

Clause 2 increases fees payable under the Companies Act.

Clause 3 changes how the taxable paid-up capital of a bank is computed.

Clause 4 provides that interest on an overpayment of corporation capital tax will no longer be included with the refund of the overpayment.

Clause 5 increases fees payable under the Corporations Registration Act.

Clause 6 adds a reference to Sections 36A and 36B to the Section of the Income Tax Act that governs the ordering of tax credits when computing an individual's tax payable under Part II of that Act.

Clause 7 provides for a $1,000 non-refundable age tax credit for seniors with a "taxable income" or "taxable income earned in Canada" of less than $24,000, effective January 1, 2014.

Clause 8 decreases the small business threshold for corporate taxes from $400,000 to $350,000 and reduces the small business corporate income tax rate from 3.5 per cent to 3.0 per cent, effective January 1, 2014.

Clause 9 increases the fee for having a special number assigned as the serial number of a vehicle.

Clause 10 increases the reinstatement fee for the restoration of a driver's licence following a revocation for an alcohol-related offence.

Clause 11 increases the deduction to be made by a prothonotary from the interest to be paid out under Section 4 of the Payment into Court Act.

Clause 12 increases registration fees payable under the Personal Property Security Act.

Clause 13 increases probate taxes.

Clause 14 capitalizes "government" in the definitions of "government director" and "non-government director" to make them consistent with the rest of the Act.

Clauses 15 and 16 require the Minister of Finance to appoint as a director of Public Service Superannuation Plan Trustee Incorporated a person recommended by the Nova Scotia Government Retired Employees Association and provides that such a director serves for such term, not exceeding 5 years, as the Association specifies.

Clause 17 increases the tax on tobacco.

Clause 18 repeals the provisions of the Sales Tax Act that deal with tax-inclusive pricing.

Clause 19 repeals the provisions of the Sales Tax Act that deal with a transitional tax that was payable from April 1, 1997 to March 31, 1998, and incorporates into the Act the provisions of the Sales Tax Act Regulations that relate to

(a) the Household Energy Rebate Program;

(b) point-of-sale rebates for books and audio books, children's clothing, children's footwear, children's diapers and feminine hygiene products;

(c) provincially administered rebates in relation to computers and vehicles for persons with specified disabilities, fire-fighting equipment for volunteer fire departments and municipalities and building materials used to repair, improve or restore heritage properties; and

(d) the First-time Home Buyer Rebate Program.

Clause 20 requires that, before the Government can introduce any bill to amend or repeal the provisions enacted by Clause 19, a referendum be held and the proposed amendment or repeal be approved by a majority of voters.

Clause 21 repeals a regulation-making power that relates to Part II of the Sales Tax Act which is repealed by Clause 18 and adds regulation-making powers respecting the conduct of a referendum required under proposed Section 12ZB.

Clauses 22 to 24 increase fees payable under the Summary Proceedings Act.

Clause 25 increases fees payable under the Trust and Loan Companies Act.

Clause 26 sets out the effective dates for the Act.

An Act Respecting Certain
Financial Measures

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Financial Measures (2013) Act.

PART I

COMPANIES ACT

2 (1) Subsection 5(2) of Chapter 81 of the Revised Statutes, 1989, the Companies Act, as enacted by Chapter 5 of the Acts of 2002 and amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one thousand and fifty dollars and sixty cents" in the second line and substituting "one thousand one hundred and eleven dollars and fifty-five cents".

(2) Subsection 5(3) of Chapter 81, as enacted by Chapter 5 of the Acts of 2002 and amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one thousand and fifty dollars and sixty cents" in the second line and substituting "one thousand one hundred and eleven dollars and fifty-five cents".

(3) Subsection 5(4) of Chapter 81, as enacted by Chapter 34 of the Acts of 2007 and amended by Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one thousand and fifty dollars and sixty cents" in the first and second lines and substituting "one thousand one hundred and eleven dollars and fifty-five cents".

(4) Subsection 5(5) of Chapter 81, as enacted by Chapter 34 of the Acts of 2007 and amended by Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one thousand and fifty dollars and sixty cents" in the first line and substituting "one thousand one hundred and eleven dollars and fifty-five cents".

PART II

CORPORATION CAPITAL TAX ACT

3 Subsection 6(1) of Chapter 99 of the Revised Statutes, 1989, the Corporation Capital Tax Act, is amended by

(a) striking out "and" at the end of clause (d);

(b) striking out clause (e) and substituting the following clauses:

(e) any other amount that, in the opinion of the Minister, is required to fairly present changes to shareholder equity; and

(f) for tax years ending after September 30, 2006, its accumulated other comprehensive income and losses,

and

(c) striking out "as calculated pursuant to paragraph 215(3)(c) or (d) and Schedules XIII and XIV of the Bank Act (Canada)," in the tenth and eleventh lines.

4 Subsection 34(1) of Chapter 99 is amended by striking out ", together with interest at the prescribed rate for the period commencing on the day the overpayment occurred and ending on the day that the overpayment is refunded, but no interest shall be paid where the amount of interest is less than one dollar" in the sixth, seventh, eighth, ninth and tenth lines.

PART III

CORPORATIONS REGISTRATION ACT

5 (1) Subsection 12(2) of Chapter 101 of the Revised Statutes, 1989, the Corporations Registration Act, as amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "thirty-four dollars and thirty cents" in the third line and substituting "thirty-six dollars and thirty cents".

(2) Subsection 12(2A) of Chapter 101, as enacted by Chapter 3 of the Acts of 2004 and amended by Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one hundred and eight dollars and sixty-two cents" in the second line and substituting "one hundred and fourteen dollars and ninety cents".

(3) Subsection 12(2B) of Chapter 101, as enacted by Chapter 3 of the Acts of 2004 and amended by Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "two hundred and fifty-one dollars and fifty-three cents" in the second and third lines and substituting "two hundred and sixty-six dollars and ten cents".

(4) Subsection 12(2C) of Chapter 101, as enacted by Chapter 3 of the Acts of 2004 and amended by Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "three hundred and eight dollars and seventy-one cents" in the second and third lines and substituting "three hundred and twenty-six dollars and sixty cents".

(5) Subsection 12(3A) of Chapter 101, as enacted by Chapter 5 of the Acts of 2002 and amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one thousand and fifty dollars and sixty cents" in the third and fourth lines and substituting "one thousand one hundred and eleven dollars and fifty-five cents".

(6) Subsection 12(7) of Chapter 101, as amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "three hundred and eight dollars and seventy-one cents" in the second last and last lines and substituting "three hundred and twenty-six dollars and sixty cents".

(7) Subsection 12(8) of Chapter 101, as amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "four hundred and ninety-one dollars and sixty-five cents" in the fourth line and substituting "five hundred and twenty dollars and fifteen cents".

PART IV

INCOME TAX ACT

6 Section 24 of Chapter 217 of the Revised Statutes, 1989, the Income Tax Act, as enacted by Chapter 9 of the Acts of 2007 and amended by Chapter 2 of the Acts of 2008 and Chapter 5 of the Acts of 2009, is further amended by adding ", 36A, 36B" immediately after "37" in the last line.

7 Chapter 217 is further amended by adding immediately after Section 36A the following heading and Section:

Subdivision jb - Age Tax Credit for Low Income Seniors

8 (1) Subsection 40(4) of Chapter 217 of the Revised Statutes, 1989, the Income Tax Act, as enacted by Chapter 6 of the Acts of 2005, is amended by

(a) striking out "and" at the end of clause (a); and

(b) striking out clause (b) and substituting the following clauses:

(b) for the first amount, "$400,000" and, for the second amount, "$1,096" for the period commencing on April 1, 2006, and ending on December 31, 2013; and

(c) for the first amount, "$350,000" and, for the second amount, "$959" for the period commencing on January 1, 2014.

(2) Subsection 40(6) of Chapter 217 is repealed and the following subsection substituted:

(6) Notwithstanding subsection (5), the business limit otherwise determined under section 125 of the Federal Act shall be deemed for the purpose of subsection (2) to be

(a) $400,000 for the period commencing on April 1, 2006, and ending on December 31, 2013; and

(b) $350,000 for the period commencing on January 1, 2014.

(3) Subsection 40(7) of Chapter 217, as enacted by Chapter 8 of the Acts of 2011 and amended by Chapter 4 of the Acts of 2012, is further amended by

(a) striking out "and" at the end of the clause (c); and

(b) striking out clause (d) and substituting the following clauses:

(d) 3.5% for the period commencing on January 1, 2013, and ending on December 31, 2013; and

(e) 3.0% for the period commencing on January 1, 2014.

PART V

MOTOR VEHICLE ACT

9 Subsection 48(2) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding "and ten cents" immediately after "two dollars" in the third line.

10 Subsection 68(1) of Chapter 293, as amended by Chapter 24 of the Acts of 1994, Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by striking out "one hundred and fourteen dollars and thirty-three cents" in the fourth line and substituting "one hundred and twenty dollars and ninety-five cents".

PART VI

PAYMENT INTO COURT ACT

11 Section 4 of Chapter 338 of the Revised Statutes, 1989, the Payment into Court Act, as amended by Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007 and Chapter 8 of the Acts 2011, is further amended by striking out "five and eighty" in the sixth line and substituting "six and fourteen".

PART VII

PERSONAL PROPERTY SECURITY ACT

12 Subsection 44A(1) of Chapter 13 of the Acts of 1995-96, the Personal Property Security Act, as enacted by Chapter 3 of the Acts of 2004 and amended by Chapter 9 of the Acts of 2007, Chapter 2 of the Acts of 2008, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by

(a) striking out "24.36" in the fifth line of clause (a) and substituting "25.75";

(b) striking out "8.51" in the seventh line of clause (a) and substituting "9.00";

(c) striking out "571.68" in the fourth line of clause (b) and substituting "604.85";

(d) striking out "8.51" in the fifth line of clause (c) and substituting "9.00";

(e) striking out "571.68" in the fourth line of clause (d) and substituting "604.85";

(f) striking out "11.45" in clause (e) and substituting "12.10"; and

(g) striking out "571.68" in the second line of clause (f) and substituting "604.85".

PART VIII

PROBATE ACT

13 Subsection 87(2) of Chapter 31 of the Acts of 2000, the Probate Act, as amended by Chapter 5 of the Acts of 2001, Chapter 5 of the Acts of 2002, Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by

(a) striking out "$78.54" in clause (a) and substituting "$83.10";

(b) striking out "$197.48" in the second line of clause (b) and substituting "$208.95";

(c) striking out "$328.65" in the second line of clause (c) and substituting "$347.70";

(d) striking out "$920.07" in the second line of clause (d) and substituting "$973.45";

(e) striking out "$920.07" in the first line of clause (e) and substituting "$973.45"; and

(f) striking out "$15.53" in the second line of clause (e) and substituting "$16.45".

PART IX

PUBLIC SERVICE SUPERANNUATION ACT

14 Section 2 of Schedule B of Chapter 4 of the Acts of 2012, the Public Service Superannuation Act, is amended by

(a) striking out "government" in the first line of clause (zc) and substituting "Government";

(b) striking out "non-government" in the first line of clause (zg) and substituting "non-Government"; and

(c) striking out "government" in the first and second lines of clause (zg) and substituting "Government".

15 (1) Clause 7(1)(d) of Schedule B is amended by striking out "to represent retirees" and substituting "from persons recommended by the Nova Scotia Government Retired Employees Association".

(2) Subsection 7(4) of Schedule B is repealed and the following subsection substituted:

(3) Subsection 7(5) of Schedule B is amended by striking out "or (c)" in the first and second lines and substituting ", (c) or (d)".

16 (1) Subsection 8(1) of Schedule B is amended by striking out ", (d)" in the first line.

(2) Subsection 8(2) of Schedule B is repealed and the following subsection substituted:

REVENUE ACT

17 Subsection 34(1) of Chapter 17 of the Acts of 1995-96, the Revenue Act, as amended by Chapter 21 of the Acts of 1996, Chapter 3 of the Acts of 1997, Chapter 13 of the Acts of 1998, Chapter 5 of the Acts of 1999 (2nd Session), Chapters 3 and 48 of the Acts of 2001, Chapter 5 of the Acts of 2002, Chapter 4 of the Acts of 2003, Chapter 3 of the Acts of 2004, Chapter 9 of the Acts of 2007 and Chapter 5 of the Acts of 2009, is further amended by

(a) striking out "twenty-one and fifty-two one hundreds cents" in the first line of clause (a) and substituting "twenty-three and fifty-two one-hundredths cents";

(b) striking out "twenty and zero one hundreds cents" in the first line of clause (b) and substituting "twenty-two cents";

(c) striking out "twenty-one and fifty-two one hundreds cents" in the first line of clause (c) and substituting "twenty-three and fifty-two one-hundredths cents"; and

PART XI

SALES TAX ACT

18 Part II of Chapter 31 of the Acts of 1996, the Sales Tax Act, is repealed.

19 Part IV of Chapter 31 is repealed and the following Parts substituted:

20 Chapter 31 is further amended by adding immediately before Section 13 the following Section:

21 Subsection 13(1) of Chapter 31, as amended by Chapter 2 of the Acts of 2006, is further amended by

(a) striking out the comma at the end of subclause (e)(ix) and substituting a semicolon;

(b) striking out subclause (e)(x); and

(c) adding immediately after clause (fa) the following clause:

PART XII

SUMMARY PROCEEDINGS ACT

22 Section 4A of Chapter 450 of the Revised Statutes, 1989, the Summary Proceedings Act, as enacted by Chapter 4 of the Acts of 2000 and amended by Chapter 5 of the Acts of 2001, Chapter 3 of the Acts of 2004, Chapter 2 of the Acts of 2006, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by

(a) striking out "one hundred and twelve dollars and forty-one cents" in the second line and substituting "one hundred and eighteen dollars and ninety-five cents"; and

(b) striking out "thirty-three dollars and sixty-two cents" in the last line and substituting "thirty-five dollars and fifty-five cents".

23 (1) Subsection 8(6) of Chapter 450, as amended by Chapter 4 of the Acts of 2000, Chapter 5 of the Acts of 2001, Chapter 2 of the Acts of 2006, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by

24 Subsection 9(5) of Chapter 450, as amended by Chapter 4 of the Acts of 2000, Chapter 5 of the Acts of 2001, Chapter 2 of the Acts of 2006, Chapter 5 of the Acts of 2009 and Chapter 8 of the Acts of 2011, is further amended by

(a) striking out "one hundred and twelve dollars and forty-one cents" in the second line and substituting "one hundred and eighteen dollars and ninety-five cents"; and

PART XIII

TRUST AND LOAN COMPANIES ACT

25 Section 16A of Chapter 7 of the Acts of 1991, the Trust and Loan Companies Act, is repealed and the following Section substituted:

EFFECTIVE DATES

26 (1) Section 4 has effect on and after June 1, 1986.

(2) Section 3 has effect on and after September 30, 2006.

(3) Sections 2, 11 to 13 and 25 have effect on and after April 1, 2013.

(4) Section 17 has effect on and after April 5, 2013.

(5) Section 5 has effect on and after May 1, 2013.

(6) Sections 9 and 10 have effect on and after June 1, 2013.

(7) Sections 22 to 24 come into force on such day as the Governor in Council orders and declares by proclamation.
