This Bill amends the Motor Vehicle Act to permit two-wheeled self-balancing battery-powered electric vehicles to be used
(a) on roadways, by including the vehicles in the definition of "bicycle" in the Act; and
(b) on sidewalks and in safety zones and crosswalks, by deeming their drivers to be pedestrians when on or in these places and by overriding provisions that would require them to drive on roadways or in bicycle lanes only.
The Bill also clarifies that provisions that prohibit passengers on bicycles, require bicycle helmets and prohibit trick riding continue to apply to these drivers while they are deemed to be pedestrians, and provisions that require they follow the flow of traffic and ride single file do not.
(a) striking out "or" at the end of subclause (i); and
(b) adding immediately after the subclause (i) the following subclause:
2 Chapter 293 is further amended by adding immediately after Section 171B the following Section:
(2) A person who is lawfully driving a bicycle that is a t wo-wheeled self-balancing battery-powered electric vehicle is deemed to be a pedestrian while driving the vehicle on a sidewalk, through or over a safety zone or in a crosswalk.
(3) Sections 169 and 170A and subsection 171(1) continue to apply to a person to whom subsection (2) applies and subsections 171(5) and (6) do not apply to such a person.
