An Act to Provide
for an Accounting of the Funds Held
by the Bluenose II Preservation Trust Society

WHEREAS the Bluenose II Preservation Trust Society was incorporated to raise funds to ensure the full operational status of the Bluenose II;

AND WHEREAS funds were raised through public donations and sales in the Bluenose II Company Store;

AND WHEREAS the assets of the Bluenose II Preservation Trust Society were transferred to the Schooner Bluenose Foundation;

AND WHEREAS the Bluenose II Preservation Trust Society 's books of account are needed for the Schooner Bluenose Foundation to have a full accounting of all funds raised and those transferred;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Bluenose Trust Accountability Act.

2 In this Act,

(a) "Bluenose Trust" means the Bluenose II Preservation Trust Society;

(b) "Foundation" means the Schooner Bluenose Foundation;

(c) "Minister" means the Minister of Economic and Rural Development and Tourism.

3 The Directors of the Bluenose Trust shall, before January 1, 2013, provide to the Foundation all books of account, including all records, documents, books, accounts and vouchers, relating to any and all funds raised by the Bluenose Trust.

4 (1) The Auditor General shall audit the books of account and all information provided to the Foundation pursuant to Section 3.

(2) All past and present Directors of the Bluenose Trust shall provide such information and explanation as, in the opinion of the Auditor General, is necessary.

5 (1) The Auditor General shall deliver a report to the Minister containing the audited results of the books of account and such other financial reports and matters as the Auditor General considers to be of public interest in relation to the Bluenose Trust.

(2) The Minister shall table the report of the Auditor General in the House of Assembly or, where the House is not then sitting, file the report with the Clerk of the House.
