Explanatory Note

This Bill

(a) updates references to the minister responsible for the Act and to the deputy minister, or his or her designate, who is a member of the Board;

(b) provides that the Provincial Archivist is appointed in accordance with the Civil Service Act rather than by the Governor in Council on the recommendation of the minister; and

(c) removes the Chief Justice of Nova Scotia as a member and as Chair of the Board of Trustees of the Public Archives of Nova Scotia.

An Act to Amend Chapter 24
of the Acts of 1998,
the Public Archives Act

Be it enacted by the Governor and Assembly as follows:

1 Clause 2(d) of Chapter 24 of the Acts of 1998, the Public Archives Act, is amended by striking out "Education and Culture" in the first and second lines and substituting "Communities, Culture and Heritage".

2 Subsection 6(1) of Chapter 24 is amended by striking out " by the Governor in Council upon the recommendation of the Board in consultation with the Minister " in the second and third lines and substituting " appointed in accordance with, and subject to, the Civil Service Act ".

3 Subsection 10(1) of Chapter 24 is amended by

(a) striking out clause (b); and

(b) striking out "Education and Culture" in the second line and substituting "Communities, Culture and Heritage".

4 Subsection 12(1) of Chapter 24 is repealed and the following subsection substituted:
