An Act Respecting the Review of the
Green Energy Equipment Tax Credit in
Manitoba for Implementation in Nova Scotia

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Green Energy Promotion Act.

2 In this Act,

(a) "Ministers" means the Minister of Energy, the Minister of Environment and the Minister of Finance;

(b) "Green Energy Equipment Tax Credit" means the tax credit provided for in the Green Energy Equipment Tax Credit Regulations made under the Income Tax Act (Manitoba) enacted in Manitoba in 2007 to encourage new and expanded manufacturing of machinery and use of equipment to produce renewable energy.

3 Subject to Section 5, the Ministers shall carry out a review of the Green Energy Equipment Tax Credit and shall consider the implementation of a similar credit in the Province and

(a) a tax credit for geothermal heat pumps;

(b) a tax credit for solar thermal energy systems;

(c) the costs associated with the implementation of the Green Energy Credit and the tax credits referred to in clauses (a) and (b); and

(d) the cost effectiveness of implementing the Green Energy Tax Credit and the tax credits referred to in clauses (a) and (b).

4 The Minister of Energy shall table a report setting out the findings arising from the review in the House of Assembly by January 31, 2010.

5 The moneys required for the purpose of this Act shall be paid out of moneys appropriated for that purpose by the Legislature.
