Explanatory Notes

Clause 1 expands the protection given to persons performing various dispute-resolution roles under the Trade Union Act from being compelled to give evidence in Court about information received in the carrying out of those roles.

Clause 2 corrects an incorrect cross-reference in the Act.

Clause 3 establishes a new mediation-arbitration option to resolve grievances.

Clause 4 provides that the Act comes into force on proclamation.

An Act to Amend Chapter 475
of the Revised Statutes, 1989,
the Trade Union Act

Be it enacted by the Governor and Assembly as follows:

1 Section 9 of Chapter 475 of the Revised Statutes, 1989, the Trade Union Act, is amended by

(a) adding "(1)" immediately after the Section number;

(b) adding ", mediation officer" immediately after "officer" in the second line; and

(c) adding the following subsection:

2 Clause 19(1)(k) of Chapter 475, as amended by Chapter 61 of the Acts of 2005, is further amended by striking out "56A" in the third line and substituting "54A".

3 Chapter 475 is further amended by adding immediately after Section 46C the following heading and Section:

MEDIATION-ARBITRATION
4 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
