An Act to Create a Community Lands Trust
to Protect Significant Land in Nova Scotia

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Community Lands Trust Act.

2 The purpose of this Act is to establish a community land trust entity that is not under the control of Government of the Province.

3 In this Act, "Trust" means the Community Lands Trust.

4 There is hereby established a trust under the name "Community Lands Trust".

5 The purpose of the Trust is to

(a) define and identify significant land and purchase that land, the development rights to that land or easements to ensure public access to that land; and

(b) create a mechanism for the public to acquire land that has broad community significance.

6 The Trust meets the standards of a non-controlled government entity as defined by the Canadian Public Sector Accounting Standards.

7 (1) The Governor in Council may make regulations

(a) establishing the manner in which the Trust is to be governed, including the method of selecting the board of directors and its chair and the inclusion of First Nations representation on the Board;

(b) establishing criteria by which the Trust determines whether a parcel of land is significant;

(c) respecting the consideration of land-settlement issues for First Nations;

(d) establishing criteria by which purchases by the Trust of land, development rights and easements take place;

(e) establishing financial practices for the Trust, including the maximum amount of money the Trust may borrow to complete its work;

(f) outlining requirements for private-sector contributions of money or land from individuals and businesses;

(g) establishing the Trust as a charitable organization;

(h) establishing methods of revenue generation for the Trust from identified parcels to allow for loan repayments.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.
