Explanatory Note
This Bill ratifies the new Civil Procedure Rules which come into effect on January 1, 2009.
An Act to Amend Chapter 240
of the Revised Statutes, 1989,
the Judicature Act
Be it enacted by the Governor and Assembly as follows:
1 Section 47 of Chapter 240 of the Revised Statutes, 1989, the Judicature Act, is amended by adding immediately after subsection (3) the following subsection:
(3A) Notwithstanding subsections (1) to (3) and Section 51,
the Civil Procedure Rules made by the judges of the Court of Appeal and the Supreme Court on the
sixth day of June, 2008, and tabled in the House of Assembly by the Minister of Justice, are
hereby ratified and confirmed and are declared to be the Civil Procedure Rules of the Court of
Appeal and the Supreme Court and shall have the force of law as and to the extent provided in
those Civil Procedure Rules until varied in accordance with the provisions of this Act.
2 This Act comes into force on such day as the
Governor in Council orders and declares by proclamation.
