Explanatory Note
This Bill prohibits the sale of cigarillos that include flavouring agents other than a few listed exceptions.
An Act to Amend Chapter 14
of the Acts of 1993,
the Tobacco Access Act
Be it enacted by the Governor and Assembly as follows:
1 Section 3 of Chapter 14 of the Acts of 1993, the Tobacco Access Act, as amended by Chapter 12 of the Acts of 1999, is further amended by relettering clause (a) as clause (ab) and adding immediately after that clause the following clauses:
(a) "cigar" means tobacco in the form of a roll or tubular construction intended for smoking that consists of a filler of pieces of natural or reconstituted leaf tobacco, a binder of natural or reconstituted leaf tobacco in which the filler is wrapped and a wrapper of natural or reconstituted leaf tobacco;
(aa) "cigarillo" means a cigar that may or may not have a binder and that is 120 millimetres or less in length;
2 Section 7 of Chapter 14,
as enacted by Chapter 12 of the Acts of 1999, is amended by
(a) striking out "or" at the end of clause (a);
(b) striking out the period at the end of clause (b) and substituting "; or"; and
(c) adding immediately after clause (b) the following clause:
(c) cigarillos that include flavouring agents except those flavouring agents listed in the Schedule to this Act.
3 Subsection 13(1) of Chapter 14,
as amended by Chapter 47 of the the Acts of 2006, is further amended by adding immediately after clause (aa) the following clause:
(ab) amending the Schedule to this Act;
4 Chapter 14 is further amended by adding immediately after Section 14 the following Schedule:
