Explanatory Notes

Subclause 1(1) authorizes the Election Commission to make recommendations to the Chief Electoral Officer respecting amendments for the improvement of the Elections Act and related legislation.

Subclause 1(2) removes the Chief Electoral Officer as a member of the Election Commission.

Subclause 1(3) eliminates the mandatory retirement of the Chairman of the Election Commission at age 65 years unless extended by the Governor in Council.

Subclause 1(4) permits the official agent or campaign manager of a candidate to be a member of the Election Commission.

Subclause 1(5) removes words made redundant by subclause 1(2).

Clause 2 entitles the Chief Electoral Officer to participate in the meetings of the Election Commission.

Clause 3 permits the Chief Electoral Officer to allow persons, other than those allowed by the Act, to be in a polling station for educational purposes.

Clause 4 restricts the recount by a judge provisions of the Elections Act to a recount for the purpose of challenging the election.

Clause 5 provides for a recount by the Chief Electoral Officer for the purpose of determining a candidate's eligibility for reimbursement for election expenses and the amount of the reimbursement.

Clause 6 provides that the report of the Chief Electoral Officer may include recommendations of the Election Commission respecting amendments for the improvements of the Elections Act and related legislation as authorized by subclause 1(1).

A candidate who is elected or receives at least 15% of the valid votes cast in an election receives reimbursement for election expenses up to 25¢ per elector, adjusted for inflation. Clause 7 provides for reimbursement for candidates receiving less than 15% but more than 13% of the valid votes cast, but the reimbursement is reduced by 1% for each fiftieth of a per cent of votes cast received less than 15% of the valid votes cast.

Clause 8 provides that the report of an official agent of a candidate is made to the Chief Electoral Officer, how the report is to be published by the Chief Electoral Officer and the cost for copies of the report and removes the provision respecting the delivery to the candidate or destruction of invoices, receipts and vouchers.

Clause 9 provides how the report of the official agent of a party is to be published by the Chief Electoral Officer and the cost for copies of the report and removes the provision respecting the delivery to the party leader or destruction of invoices, receipts and vouchers.

Clause 10 provides how an error in the report of the official agent of a candidate or party is to be published by the Chief Electoral Officer.

Clause 11 provides for the coming into force of the Act.

An Act to Amend Chapter 140
of the Revised Statutes, 1989,
the Elections Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 8(1) of Chapter 140 of the Revised Statutes, 1989, the Elections Act, as amended by Chapter 4 of the Acts of 1991, is amended by adding immediately before clause (b) the following clause:

(2) Subsection 8(2) of Chapter 140 is amended by

(a) adding "and" at the end of clause (a); and

(b) striking out clause (b).

(3) Subsection 8(3) of Chapter 140 is amended by striking out everything after "re-appointed" in the second line to the end of the subsection and substituting a period.

(4) Subsection 8(8) of Chapter 140 is amended by

(a) striking out the semicolon at the end of clause (b) and substituting a period; and

(b) striking out clause (c).

(5) Subsection 8(10) of Chapter 140 is amended by striking out "other than the Chief Electoral Officer" in the fourth and fifth lines.

2 Chapter 140 is further amended by adding immediately after Section 8 the following Section:

3 Section 92 of Chapter 140, as amended by Chapter 43 of the Acts of 2001, is further amended by

(a) striking out "and" at the end of clause (f);

(b) striking out the period at the end of clause (g) and substituting "; and"; and

(c) adding immediately after clause (g) the following clause:

4 Subsection 160(1) of Chapter 140, as amended by Chapter 43 of the Acts of 2001, is further amended by adding ", for the purpose of challenging the election of a candidate," immediately after "may" in the fourth line.

5 Chapter 140 is further amended by adding immediately after Section 167 the following Section:

6 Clause 172(1)(b) of Chapter 140 is amended by adding ", including any recommendations made to the Chief Electoral Officer pursuant to clause (a) of subsection (1) of Section 8" immediately after "Act" in the last line.

7 Section 182 of Chapter 140, as amended by Chapter 17 of the Acts of 2005, is further amended by adding immediately after subsection (1) the following subsection:

8 (1) Subsection 183(1) of Chapter 140 is amended by striking out "returning officer" in the third line and substituting "Chief Electoral Officer".

(2) Subsection 183(2) of Chapter 140 is repealed and the following subsection substituted:

(3) Subsection 183(3) of Chapter 140 is amended by

(a) striking out "returning officer" in the first and in the fourth lines and substituting in each case "Chief Electoral Officer"; and

(b) striking out "a fee of one dollar" in the last two lines and substituting "the actual cost of providing copies of the requested report, invoices, receipts or vouchers".

(4) Subsection 183(4) of Chapter 140 is repealed.

9 (1) Subsection 184(2) of Chapter 140 is repealed and the following subsection substituted:

(2) Subsection 184(3) of Chapter 140 is amended by striking out "a fee of one dollar" in the last line and substituting "the actual cost of providing copies of the requested report, invoices, receipts or vouchers".

(3) Subsection 184(4) of Chapter 140 is repealed.

10 Subsection 186(2) of Chapter 140 is repealed and the following subsections substituted:

11 Notwithstanding subsection 219(2) of Chapter 140,

(a) subject to clause (b), this Act has effect for the next general election;

(b) Section 7 has effect for the general election held June 13, 2006,

upon the Governor in Council so ordering and declaring by proclamation.
