Explanatory Note

This Bill clarifies the procedures hospitals must follow in obtaining consent for the release of patient records.

An Act to Amend Chapter 208
of the Revised Statutes, 1989,
the Hospitals Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 71(2) of Chapter 208 of the Revised Statutes, 1989, the Hospitals Act, as enacted by Chapter 42 of the Acts of 2005, is amended by striking out "and who is selected by the psychiatrist" in the sixth line.

(2) Subsection 71(2A) of Chapter 208, as enacted by Chapter 42 of the Acts of 2005, is amended by striking out "to treatment" in the third line.

(3) Subsection 71(2G) of Chapter 208 is repealed.

2 This Act has effect on and after such day as the Governor in Council orders and declares by proclamation.
