An Act to Require that Government
Buildings Constructed in the Future
Comply with Green Energy and
Environmental Design Standards

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Green Buildings Act.

2 In this Act, "LEED building standards" means the Leadership in Energy and Environmental Design rating system developed by the Canada Green Building Council.

3 Notwithstanding any enactment, every building constructed by Her Majesty in right of the Province after May 1, 2008, must meet LEED building standards.

4 For greater certainty, this Act does not apply to buildings being constructed by Her Majesty in right of the Province if contracts with respect to the construction have been signed before the coming into force of this Act.

5 (1) The Governor in Council may make regulations

(a) defining any expression used but not defined in this Act;

(b) the Governor in Council considers necessary or advisable to carry out effectively the intent and purpose of this Act.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.
