This Bill requires the Nova Scotia Utility and Review Board to either prescribe conditions on a licence or to refuse to grant, renew or transfer a licence f or the sale of liquor on premises if the Board determines that the quiet enjoyment of neighbouring properties will be, is likely to be or is being interfered with.

1 Chapter 260 of the Revised Statutes, 1989, the Liquor Control Act, is amended by adding immediately after Section 46A the following Section:

46B (1) In determining whether to grant, renew or transfer a licence for the sale of liquor on premises, the Board shall consider whether the quiet enjoyment of neighbouring properties will be, is likely to be or is being interfered with as a result.

(2) Where, pursuant to subsection (1), the Board determines that the quiet enjoyment of neighbouring properties will be, is likely to be or is being interfered with, the Board shall

(a) prescribe such conditions as it deems advisable on the grant, renewal or transfer of the licence; or

(b) refuse to grant, renew or transfer the licence.
