Explanatory Note

Clause 1 changes a reference to the former Village Service Act to the Municipal Government Act.

Clauses 2 to 7 update the language to gender-neutral language.

Clause 8

(a) increases the amount of the Chairman's honorarium from five hundred dollars to two thousand two hundred and twenty-five dollars;

(b) updates the language to gender-neutral language;

(c) increases the honorarium for a water commissioner from two hundred and fifty dollars to one thousand one hundred and twelve dollars;

(d) updates the language to gender-neutral language; and

(e) requires the Chairman's honorarium to be pro-rated where the term is less than 12 months.

Clause 9 changes a reference to the former Board of Commissioners of Public Utilities to the Nova Scotia Utility and Review Board.

Clause 10 changes a reference to the former Village Service Act to the Municipal Government Act.

Clause 11

(a) changes a reference to the former Village Service Act to the Municipal Government Act; and

(b) changes a reference to the former Minister of Municipal Affairs to the Minister of Service Nova Scotia and Municipal Relations.

An Act to Amend Chapter 89
of the Acts of 1982,
the New Minas Water Commission Act

Be it enacted by the Governor and Assembly as follows:

1 Clause 2(f) of Chapter 89 of the Acts of 1982, the New Minas Water Commission Act, is amended by striking out "Village Service" in the second line and substituting "Municipal Government".

2 Subsection 5(2) of Chapter 89 is amended by

(a) striking out "he" in the second line and substituting "the person"; and

(b) striking out "his" in the fifth line and substituting "the person's".

3 Subsection 6(3) of Chapter 89 is amended by striking out "he" in the third line and substituting "the person".

4 Subsection 7(2) of Chapter 89 is amended by

(a) striking out "he" in the third line and substituting "the person"; and

(b) striking out "he replaces" in the third and fourth lines and substituting "being replaced".

5 Subsection 8(1) of Chapter 89 is repealed and the following subsection substituted:

6 Subsection 9(1) of Chapter 89 is amended by striking out "his" in the second line and substituting "the person's".

7 Subsection 10(3) of Chapter 89 is amended by

(a) striking out "he" in the second line and substituting "the Chairman or Vice-Chairman, as the case may be,"; and

(b) striking out "his" in the third line and substituting "the Chairman or Vice-Chairman's".

8 (1) Subsection 11(1) of Chapter 89 is amended by

(a) striking out "five hundred" in the second line and substituting "two thousand two hundred and twenty-five"; and

(b) striking out "he" in the third line and substituting "the Chairman".

(2) Subsection 11(2) of Chapter 89 is amended by

(a) striking out "two hundred and fifty" in the second and third lines and substituting "one thousand one hundred and twelve"; and

(b) striking out "he" in the fourth line and substituting "the person".

(3) Subsection 11(3) of Chapter 89 is amended by striking out "reduced by an amount determined by the Board" in the fourth and fifth lines and substituting "pro-rated over the number of months served".

9 Subsection 17(1) of Chapter 89 is amended by

(a) striking out "Board of Commissioners of Public Utilities" in the first and second lines of clause (h) and substituting "Nova Scotia Utility and Review Board"; and

(b) striking out "Board of Commissioners of Public Utilities" in the second line of subclause (i)(iii) and substituting "Nova Scotia Utility and Review Board".

10 Section 19 of Chapter 89 is amended by striking out "Village Service" in the second and third lines and substituting "Municipal Government".

11 Section 21 of Chapter 89 is amended by

(a) striking out "Village Service" in the first line and substituting "Municipal Government"; and

(b) striking out "Municipal Affairs" in the third line and substituting "Service Nova Scotia and Municipal Relations".
