This Bill provides that a child need only be five years of age by December 31st in the year in which the child starts school.

1 Section 5 of Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after subsection (2) the following subsection:

(2A) Notwithstanding the regulations, a person is, for the purpose of subsection (2) with respect to the 2006-07 or any subsequent school year, over the age of five years if that person has attained the age of five years by December 31st of that year and under the age of five years if that person has not attained the age of five years by December 31st of that year.

2 Notwithstanding any enactment, nothing in this Act authorizes the payment of grants out of the money of the Province to school boards pursuant to any enactment except payment out of money appropriated for the purpose of this Act by the Legislature.
