Explanatory Notes

Clause 1 changes the short title of the Emergency Measures Act to the Emergency Management Act.

Clause 2 removes one definition and changes two other definitions in the Emergency Measures Act.

Clause 3 provides that the Emergency Management Office has the powers and shall perform the duties vested in it by the Act or assigned to it by the Minister.

Subclause 4(1) enables the Minister to enter into an agreement with a state of the United States of America in respect of emergency management plans or the provision of emergency services.

Subclause 4(2) provides that a person sent to the Province under an agreement entered into under the Act, who holds a licence, certificate or permit respecting a profession, trade or other qualification is deemed to be similarly qualified in the Province when providing assistance during a state of emergency or a state of local emergency.

Subclause 5(1) adds to the regulation-making authority of the Governor in Council.

Subclause 5(2) provides that

(a) an order or regulation made under the Act may be made retroactive to the date in the order or regulation; and

(b) an order or regulation made during a state of emergency or state of local emergency comes into force immediately, notwithstanding the Regulations Act.

Clause 6 makes changes that are necessary as a result of the changes made in Clauses 1 to 3.

Clause 7 amends the Public Service Act to establish the Emergency Management Office.

Clause 8 provides that the Act comes into force on proclamation.

An Act to Amend Chapter 8
of the Acts of 1990,
the Emergency Measures Act,
and Chapter 376
of the Revised Statutes, 1989,
the Public Service Act

Be it enacted by the Governor and Assembly as follows:

1 Section 1 of Chapter 8 of the Acts of 1990, the Emergency Measures Act, is amended by striking out "Measures" in the first line and substituting "Management".

2 Section 2 of Chapter 8 is amended by

(a) striking out clause (a);

(b) striking out clause (c) and substituting the following clause:

and

(c) striking out clause (g) and substituting the following clause:

3 Section 4 of Chapter 8 is repealed and the following Section substituted:

4 (1) Clause 7(1)(a) of Chapter 8 is amended by

(a) adding ", a state of the United States of America" immediately after "municipality" in the second line; and

(b) adding "or the provision of emergency services" immediately after "plans" in the fourth line.

(2) Section 7 of Chapter 8 is further amended by adding immediately after subsection (1) the following subsection:

5 (1) Subsection 25(1) of Chapter 8 is amended by adding immediately after clause (b) the following clause:

(2) Section 25 of Chapter 8 is further amended by adding immediately after subsection (2) the following subsections:

6 Chapter 8 is further amended by

(a) striking out "measures" wherever it appears in Chapter 8 and substituting in each case "management"; and

(b) striking out "Measures Organization" wherever it appears in Chapter 8 and substituting in each case "Management Office".

7 Chapter 376 of the Revised Statutes, 1989, the Public Service Act, is amended by adding immediately after Section 25L the following Section:

8 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
