Explanatory Notes

Clause 1 amends the provisions of the Vital Statistics Act, relating to who must register the birth of a child, to remove references to "legitimate" and "illegitimate" children and to provide for cases where the father is not known to the mother or not acknowledged by the mother.

Clause 2 provides a mechanism whereby the Supreme Court of Nova Scotia (Family Division) or the Family Court of Nova Scotia may order registration or the rescinding of registration of the name and particulars of the father of a child without the consent of the father or the mother of the child and provides for the use of genetic testing. The Court is given the discretion not to make an order if that is in the best interest of the child.

Clause 3 provides that this Act comes into force on proclamation.

An Act to Amend Chapter 494
of the Revised Statutes, 1989,
the Vital Statistics Act

Be it enacted by the Governor and Assembly as follows:

1 Clauses 4(2)(a) to (c) of Chapter 494 of the Revised Statutes, 1989, the Vital Statistics Act, are repealed and the following clauses substituted:

2 Chapter 494 is further amended by adding immediately after Section 11 the following Sections:

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
