Explanatory Note
This Bill amends the Freedom of Information and Protection of Privacy Act to prohibit the
disclosure of the identity of an applicant except to the extent necessary to deal with a request
for access to a record.
An Act to Amend Chapter 5
of the Acts of 1993,
the Freedom of Information
and Protection of Privacy Act
Be it enacted by the Governor and Assembly as follows:
1 Section 7 of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection
of Privacy Act, as amended by Chapter 11 of the Acts of 1999 (2nd Session), is further
amended by adding immediately after subsection (1) the following subsection:
(1A) The head of a public body to which a request is made for access to a record, or any
officer or employee of the public body, shall not disclose the identity of the applicant to
any person except to the extent that disclosure is necessary for the request to be dealt
with in accordance with this Act.
