Explanatory Note

This Bill changes the length of time a peace officer may detain a seized off-highway vehicle from twenty-four hours to until such time as the peace officer has determined that there are insufficient grounds to lay a charge or, where a charge has been laid, until such time as the court makes a decision.

An Act to Amend Chapter 323
of the Revised Statutes, 1989,
the Off-highway Vehicles Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 19(1) of Chapter 323 of the Revised Statutes, 1989, the Off-highway Vehicles Act, is amended by striking out "for a period not exceeding twenty-four hours" in the fourth and fifth lines.

(2) Section 19 of Chapter 323 is further amended by adding immediately after subsection (1) the following subsection:
