An Act to Implement Measures Agreed to
by the Government of Nova Scotia and
the Government of Canada Respecting
Occupational Health and Safety in the Offshore

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Offshore Occupational Health and Safety Act.

2 (1) In this Section, "offshore area" means the offshore area as defined in the Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation (Nova Scotia) Act.

(2) The Governor in Council may make regulations the Governor in Council considers necessary or advisable to implement measures agreed to by the Government of the Province and the Government of Canada with respect to occupational health and safety in the offshore area including, without limiting the generality of the foregoing, regulations

(a) prescribing penalties in respect of contraventions of these regulations;

(b) respecting inspection and investigation procedures and powers of a safety officer;

(c) respecting the powers and procedures of a safety officer in the issuance of directives or orders;

(d) respecting appeals, stays and the enforcement of directives or orders;

(e) defining any word or expression used but not defined in this Act.

(3) The exercise by the Governor in Council of the authority contained in subsection (2) is regulations within the meaning of the Regulations Act.

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
