Explanatory Notes

Clause 1 restricts to whom a birth certificate may be issued and permits a certified copy, photostatic copy or photographic copy of the registration of a birth to be issued to the person to whom the registration applies or a parent shown on the birth registration.

Clause 2 creates a new offence and penalty for obtaining or attempting to obtain a birth certificate or a certified copy, photostatic copy or photographic copy of the registration of a birth.

Clause 3 gives additional regulation-making power to the Governor in Council respecting applications for birth certificates or certified copies, photostatic copies or photographic prints of the registration of births.

Clause 4 makes the amendments to the Vital Statistics Act effective upon proclamation.

An Act to Amend Chapter 494
of the Revised Statutes, 1989
the Vital Statistics Act

1 (1) Subsections 37(1) and (2) of Chapter 494 of the Revised Statutes, 1989, the Vital Statistics Act, are repealed and the following subsections substituted:

(2) Subsection 37(3) of Chapter 494 is amended by striking out "(b) of subsection (2)" in the second line and substituting "(e) of subsection (2) or clause (b) of subsection (2D)".

(3) Subsection 37(10) of Chapter 494 is amended by striking out "(2)" in the sixth line and substituting "(2D)".

2 Chapter 494 is further amended by adding immediately after Section 49 the following Section:

3 Subsection 51(1) of Chapter 494 is amended by adding immediately after clause (g) the following clause:

4 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
