Explanatory Note

This Bill

(a) confirms that the Dean of Nova Scotia and Prince Edward Island is normally the Rector of the Cathedral Church of All Saints and that as the senior priest of the Diocese of Nova Scotia and Prince Edward Island is directly responsible to the Bishop of the Diocese;

(b) changes the name of the Committee of Consultation and Advice of the Cathedral Church of All Saints to the Congregational Council;

(c) continues the offices of Dean's Warden and Cathedral Warden;

(d) enables the congregation of the Cathedral to make by-laws respecting the internal management of the affairs of the Cathedral and its congregation;

(e) continues the corporation formerly known as the "Congregation of All Saints' Cathedral Halifax" under the name "Congregation of the Cathedral Church of All Saints, Halifax" and provides that the corporation consists of the Dean, the Dean's Warden, the Cathedral Warden and the other members of the Congregational Council;

(f) removes gender-specific references from the Act; and

(g) replaces all references in the Act to All Saints Cathedral with "Cathedral Church of All Saints".

An Act to Amend Chapter 208
of the Acts of 1906,
An Act respecting the Cathedral Church
of the Diocese of Nova Scotia

Be it enacted by the Governor and Assembly as follows:

1 Chapter 208 of the Acts of 1906, An Act respecting the Cathedral Church of the Diocese of Nova Scotia, is amended by adding immediately after Section 6 the following Sections:

2 Section 7 of Chapter 208 is amended by

(a) striking out "clergyman" wherever it appears in clauses (e) and (f) and substituting in each case "member of the clergy"; and

(b) striking out all of that Section except clauses (e) and (f) and substituting the following:

3 Chapter 208 is further amended by adding immediately after Section 7 the following Section:

4 Section 8 of Chapter 208 is repealed and the following Section substituted:

5 Chapter 208 is further amended by striking out "All Saints Cathedral" wherever it appears in Chapter 208 and substituting in each case "Cathedral Church of All Saints".

6 (1) This Act has effect on and after February 21, 1999.

(2) Nothing in subsection (1) affects the rights acquired by any person from a judgment or order given in litigation or proceedings commenced on or before May 17, 2001.
