An Act to Protect the Occupational
Health and Safety of Workers

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Workers Health and Safety Act.

2 Within six months of the coming into force of this Act, the Governor in Council shall enact the following regulations:

(a) Indoor Air Quality Regulations; and

(b) Violence in the Workplace Regulations.

3 (1) The Minister of Environment and Labour shall submit annually to the House of Assembly a report on the state of occupational health and safety in the Province.

(2) The report shall include, but not be limited to,

(a) a summary of all workplace accidents or fatalities in the Province for the year covered by the report;

(b) a report on the work of the Occupational Health and Safety Division of the Department of Environment and Labour;

(c) a list of orders issued and charges laid;

(d) a review of any prosecutions undertaken;

(e) any new or draft regulations; and

(f) any new procedures or policies dealing with the promotion of safety in the workplace.

4 (1) Notwithstanding anything contained in the Occupational Health and Safety Act, all officers and directors of a corporation have a duty to secure and maintain a safe workplace.

(2) An officer or director who fails to comply with subsection (1) is guilty of an offence and liable on summary conviction to the penalties prescribed under the Occupational Health and Safety Act.

5 The Director of Public Prosecutions shall ensure that at least one crown attorney is trained in and responsible for the prosecution of violations of the Environment Act and the Occupational Health and Safety Act.

6 The Minister of Environment and Labour shall review any workplace fatality and table a report in the House of Assembly summarizing the accident investigation and detailing any actions taken or recommendations arising from the investigation.
