An Act to Conserve the Bras d'Or Lakes

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Bras d'Or Lakes Conservation Act.

2 In this Act,

(a) "Bras d'Or Lakes" means the body of water known by that name and located on Cape Breton Island, and includes all harbours, inlets and tributaries of that body of water;

(b) "dumping" means the disposal of human, chemical or other waste from any watercraft;

(c) "peace officer" includes an inspector under the Environment Act or the Fisheries and Coastal Resources Act and a conservation officer under the Wildlife Act.

3 Anyone who

(a) is found to be dumping on the Bras d'Or Lakes; or

(b) is found to have been engaged in dumping,

is guilty of an offence and is liable on summary conviction to a fine of not less than one thousand dollars and not more than five thousand dollars.

4 For the purpose of enforcing this Act, a peace officer has all of the powers and authority of an inspector under the Environment Act.

5 Nothing in this Act diminishes the effect of a more stringent provision in any other enactment.
