Explanatory Note

This Bill requires every regulation made pursuant to the Occupational Health and Safety Act to include a "sunset clause". Existing regulations are deemed to include such a clause.

An Act to Amend Chapter 7
of the Acts of 1996,
the Occupational Health and Safety Act

Be it enacted by the Governor and Assembly as follows:

1 Section 82 of Chapter 7 of the Acts of 1996, the Occupational Health and Safety Act, is amended by adding immediately after subsection (1) the following subsections:

2 (1) The Temporary Workplace Traffic Control Regulations, the First Aid Regulations, the Disclosure of Information Regulations and the Workplace Hazardous Materials Information System Regulations made pursuant to the Occupational Health and Safety Act are deemed to contain a provision specifying that they are repealed four years after this subsection comes into force.

(2) Subject to subsection (1), the General Blasting Regulations, the Fall Protection and Scaffolding Regulations, the Occupational Health Regulations, the Occupational Safety General Regulations and the Appeal Panel Regulations made pursuant to the Occupational Health and Safety Act or any other regulations made pursuant to that Act before the coming into force of this subsection are deemed to contain a provision specifying that they are repealed five years after this subsection comes into force.

(3) For greater certainty, nothing in subsection (1) or (2) prevents an amendment to a regulation referred to in subsection (1) or (2) to specify a date of repeal in that regulation in accordance with subsection 82(1B) of the Occupational Health and Safety Act.

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
