Explanatory Notes

Clause 1

(a) repeals definitions of co-ordinator and district school board which are obsolete;

(b) adds a definition of district school board required by the amendments in Clause 3;

(c) removes an obsolete reference to school district in the definition of superintendent; and

(d) adds a definition of district school board for several historic transitional provisions.

Clause 2 repeals provisions respecting district school boards which no longer exist.

Clause 3 sets up a pilot project for the Southwest Regional School Board. Two elected district school boards would be created with strictly educational duties. A continued, but appointed, regional school board would keep all other duties. The superintendent would be replaced by a Chief Executive Officer for the Regional School Board and a director of education at each district school board. The project could be extended to other regional school boards.

Clause 4 makes amendments to the provisions of the Act dealing with elections to the Conseil acadien so that they mirror the provisions for election of African Nova Scotian representatives to school boards.

Clause 5 repeals provisions respecting co-ordinators who no longer exist.

Clauses 6 and 7 extend the date for a school board giving notice of the termination of a teacher's contract from May 15th to June 16th in the year 2000.

Clause 8 revokes any notice of termination, for other than just cause, of a teacher's contract given before the introduction of this Bill for the end of the 2000 school academic year and prohibits the giving of such a notice before June 2, 2000.

Clause 9 provides for the election of one African Nova Scotian to each school board by the African Nova Scotian electors of the school district.

Clause 10 makes amendments required as result of Clause 3.

Clause 11

(a) permits fees for teachers' certificates; and

(b) adds regulation-making powers respecting the creation of district school boards and respecting the Southwest Regional School Board and other designated regional school boards.

Clause 12 repeals provisions respecting school trustees who no longer exist.

Clause 13 sets out when paragraph 1(c) and Clauses 3 and 6 to 8 come into force.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 1 of the Acts of 1995-96, the Education Act, is amended by

(a) adding "(1)" after the Section number;

(b) striking out clauses (d) and (e);

(c) adding immediately after clause (c) the following clause:

(d) striking out "school district or" in the second line of clause (ah); and

(e) adding the following subsection:

2 The heading immediately before Section 6 and Section 6 of Chapter 1 are repealed.

3 Chapter 1 is further amended by adding immediately after Section 10 the following heading and Sections:

and, in particular, a district school board shall, in accordance with this Act and the regulations,

and, in particular, the Southwest Regional School Board shall, in accordance with this Act and the regulations,

4 Subsection 13(3) of Chapter 1 is amended by

(a) striking out clauses (b) and (c) and substituting the following clauses:

(b) striking out "directed by the Municipal Elections Officer" in the third and fourth lines of clause (d) and substituting "prescribed by or pursuant to the Municipal Elections Act"; and

(c) striking out clause (e) and substituting the following clause:

5 The heading immediately before Section 17 and Sections 17 to 19 of Chapter 1 are repealed.

6 (1) Subsection 30(2) of Chapter 1 is amended by adding "except subsection (3) and subsection 34(3)" immediately after "Act" in the first line.

(2) Section 30 of Chapter 1 is further amended by adding immediately after subsection (2) the following subsection:

7 Section 34 of Chapter 1 is amended by adding immediately after subsection (2) the following subsection:

8 Chapter 1 is further amended by adding immediately after Section 35 the following Section:

9 Chapter 1 is further amended by adding immediately after Section 42 the following Section:

but not both.

10 Section 40 of Chapter 1 is amended by adding immediately after subsection (2) the following subsection:

11 Subsection 146(1) is amended by

(a) adding ", and requiring the collection and payment of fees respecting initial certificates, duplicate certificates and renewal certificates" immediately after "permits" in the last line of clause (e); and

(b) adding immediately after clause (y) the following clauses:

12 The heading immediately before Section 94 and Sections 94 to 110 of Chapter 1 are repealed.

13 (1) Clause 1(c) and Section 3 come into force on such day as the Governor in Council orders and declares by proclamation.

(2) Sections 6 to 8 have effect on and after April 27, 2000.
